Premises and Definitions

These Terms and Conditions of Sale govern the purchase of products presented on the website www.leonardoshoes.com through electronic means. The site is operated by Leonardo Italian Fashion SRL, owned by Karam AlShalabi and Omar Alshalabi (VAT No. 07131780483), headquartered in Florence (FI), Via De Cerchi n.9r. These Terms and Conditions of Sale form an integral and essential part of the purchase contract for any Product, and submitting an Order implies acceptance of these terms by the Customer. To better understand the following Terms and Conditions of Sale, the following definitions apply:

  • "Consumer": any natural person who places an Order for purposes unrelated to their entrepreneurial, commercial, artisanal, or professional activity.
  • "Professional": any natural or legal person who places an Order in the course of their entrepreneurial, commercial, artisanal, or professional activity.
  • "Customer": a Consumer or a Professional.
  • "Contract": any agreement between Leonardo Italian Fashion SRL and a Customer regarding the purchase of one or more Products, concluded in accordance with the methods provided in Part A, Sections 3.3 or 3.4.
  • "Business Day": any weekday except Saturday, Sunday, and public holidays in Italy.
  • "Order": any proposal concerning the purchase of one or more Products submitted by the Customer to Leonardo Italian Fashion SRL.
  • "TCS": General Terms and Conditions of Sale.

Leonardo Italian Fashion SRL may enter into remote contracts with Customers, whether defined as Consumers or Professionals. The provisions of these TCS explicitly referring to Consumers shall apply exclusively to those who fall under the relevant definition as specified above. Consumers will benefit from all protections provided for the conclusion of remote contracts pursuant to Title III, Section II of Legislative Decree no. 206 of September 6, 2005 ("Consumer Code"), as well as all additional mandatory protections afforded to Consumers under the Consumer Code and other applicable laws, such as Directive 2000/31/EC implemented by Legislative Decree no. 70 of April 9, 2003, regarding information society services and electronic commerce, and all regulations governing remote contracts and general contract rules as established by the Civil Code, which apply in the absence of specific provisions.

The following details will be provided:

  1. The technical steps to be followed for contract conclusion;
  2. The method of archiving the concluded contract and how to access it;
  3. The tools available to the Customer to identify and correct data entry errors before submitting the order;
  4. Indications regarding dispute resolution mechanisms.

The above applies to contracts concluded between Leonardo Italian Fashion SRL and Consumers, as well as Professionals, unless otherwise agreed between the parties for the latter.

Leonardo Italian Fashion SRL is also available to provide Customers with any clarifications or information concerning:

  1. The content of the TCS,
  2. The content of the Contract and its regulations,
  3. Any complaints.

Should the Customer choose not to use the telephone service, all rights and privileges granted by law remain unaffected. Regarding saving and printing the TCS and viewing the text of the concluded Contract, refer to the provisions below.

1. Downloading and Reviewing the Terms and Conditions of the Contract

The Customer may retain a copy of these TCS, along with all documents comprising the Contract related to the Products purchased on the Site, by using the standard functions of their browser (e.g., “File” -> “Save As”). Additionally, the Customer can save their Order details either by downloading the TCS as described above, or by saving, using their browser’s functions, the data summarized on the final web page before submitting the Order. Alternatively, the Customer may wait for the Order Confirmation Email that Leonardo Italian Fashion SRL will send to the email address provided during registration. This email will contain details of the Order submitted, allowing the Customer to print or save the documentation using their email client’s functions. Each Order's details will be stored by Leonardo Italian Fashion SRL in a dedicated "Folder," which registered Customers can access to review their "Order Status." To preserve the confidentiality of this information, access is granted only after authentication in the reserved area of the Site, named “My Account,” by entering specific login credentials assigned to the Customer during registration. In this reserved area, Customers can review concluded Contracts, pending and newly submitted Orders, and update and save their contact information, payment details, and/or newsletter subscription data. The Customer agrees to keep their access credentials to the Site’s reserved area confidential and not share them with third parties.

2. Contract Formation

Any Contract related to the purchase of Products will be concluded exclusively in Italian. The presentation of Products on the Site invites users to submit a purchase proposal to Leonardo Italian Fashion SRL. Such invitations to offer are not binding for Leonardo Italian Fashion SRL and, in particular, do not constitute public offers under Article 1336 of the Civil Code. Leonardo Italian Fashion SRL reserves full discretion regarding the acceptance of any proposals. The Consumer is not definitively bound until Leonardo Italian Fashion SRL has accepted the Order submitted by the Consumer.

To purchase one or more Products via the Internet, the Customer must first register on the Site, providing Leonardo Italian Fashion SRL with all necessary data to execute the submitted Orders, in compliance with applicable data protection regulations. Once registration is complete, the Customer may select one or more Products they wish to purchase and place them in a virtual “cart,” which can always be reviewed before submitting the Order. Customers may use the system in demo mode to avoid unintended binding operations. By clicking the “Proceed to Purchase” button, the Customer initiates the Order submission process. During the Order formulation phase and until its actual submission, the Customer can review and correct data by clicking the “Back” button, allowing for the identification, correction, and/or deletion of errors or data entered up to that point. Clicking the “Complete Order” button at the end of the process submits the Order to Leonardo Italian Fashion SRL.

Upon submission, the Customer will promptly receive confirmation of Order receipt via email sent to the address provided during registration. This email will also serve as an Order Confirmation. Leonardo Italian Fashion SRL reserves the right to accept or reject Orders received, and in the event of non-acceptance, the Customer shall have no claim against Leonardo Italian Fashion SRL. The Order and Order Confirmation are deemed delivered when the parties to whom they are addressed can access them. The contract is considered concluded, and the Order accepted, when the Customer receives the Order Confirmation Email containing a description of the concluded Order.

3. Prices

3.1 Prices for Customers Residing in Italy and EU Countries

The product prices published on the website www.leonardoshoes.com reflect the actual selling price of the goods and are inclusive of VAT.

3.2 Prices for Customers Residing in Non-EU Countries

The website www.leonardoshoes.com also displays product prices reflecting the actual TAX-FREE selling price reserved exclusively for customers residing outside the European Union. The total order amount will be calculated automatically online by deducting the Value Added Tax (VAT), and the final invoice will reflect the VAT exemption.

3.3 Import Duties

Shipments destined outside the European Community are exempt from VAT but are subject to import duties (DDU - Delivery Duties Unpaid) based on the internal regulations of each country.
The payment of these import duties (DDU) is solely the responsibility of the customer. The product prices published on www.leonardoshoes.com reflect the actual selling price of the goods, excluding import taxes (based on the regulations of each country). Payment of these duties is required to release the order from customs charges. To obtain precise information about taxes and delivery charges, it is recommended to contact your nearest customs office or customs broker.

4. Shipping

4.1 Shipping Costs

Shipping costs will be calculated and added to the cart during the online purchase process. As required by trade regulations, all shipments from www.leonardoshoes.com are accompanied by an official invoice stating the value of individual items in Euros. For discounted items, the invoice will show the discounted amounts.

5. Payment and Delivery

For each order, the customer will pay the full price of the ordered products at the time of placing the order. If the order is not accepted by Leonardo Italian Fashion SRL, the company will promptly refund any amounts already paid.
During the ordering process, Leonardo Italian Fashion SRL offers several payment methods:

  1. Payment by credit, debit, or prepaid card
  2. Payment via the secure "PayPal" system
  3. Payment in installments (Scalapay or Klarna)
  4. Payment via bank transfer
  5. Cash on delivery (only for Italy).

The customer must select one of the available payment methods.

As an online retailer, the site’s sales system is not required to issue an invoice (or receipt) to private individuals without a VAT number, pursuant to Article 22 of Presidential Decree 633 of October 26, 1972, and Article 2, letter oo) of Presidential Decree 696 of December 21, 1996 (confirmed by Resolution 274/E of November 5, 2009).
To request assistance, customers should retain the purchase receipt included in the order package.

If a customer wishes to request an invoice, they should contact customer service before the order is shipped and ensure their tax code field is filled in their profile. The invoice will be issued to the address associated with the payment method and cannot be issued to a different name or address.

Leonardo Italian Fashion SRL reserves the right to reject or not process orders. For deliveries, the company will use carriers selected by Leonardo Italian Fashion SRL.

If the product chosen by the customer and subject to the concluded contract is marked as "available" on the website, the company will ship the item within 10 business days following confirmation of payment receipt.

Leonardo Italian Fashion SRL will not be held liable for non-delivery or delayed delivery if:

  1. Despite regular and timely procurement of products to fulfill the received order, the supplier fails to deliver as agreed.
  2. It is unable to overcome the unavailability of such products due to circumstances beyond its control.
  3. It promptly notifies the customer of the unavailability of the products.

In any case, if the customer is a consumer and the unavailability of the products (due to circumstances in points 1 and 2) prevents delivery, Leonardo Italian Fashion SRL will refund any advance payments made within 30 (thirty) days from the day after the order was sent.

Leonardo Italian Fashion SRL is not responsible for non-delivery or delayed delivery due to force majeure, such as strikes, government actions, energy or raw material shortages, transportation difficulties, fires, floods, or any events beyond its control. The company will promptly inform the customer of the occurrence and resolution of such force majeure events.

If the force majeure event lasts longer than 30 (thirty) days, either party may terminate the contract. In such cases, the customer will not be entitled to compensation or damages but will have the right to a refund of amounts already paid for the product within 30 days of the order date.

For purchases made by consumers, the risk of accidental loss of products remains with Leonardo Italian Fashion SRL until delivery to the consumer or another person designated by them, regardless of whether the shipment is insured. For purchases by non-consumers, the risk of accidental loss transfers to the customer upon delivery to the first carrier.

6. Gift Vouchers and Purchase Vouchers

Leonardo Italian Fashion SRL offers Gift Vouchers and Purchase Vouchers. Gift Vouchers can be purchased on the website. Purchase Vouchers are not available for purchase but are offered by the company during promotional campaigns for a limited time. Please note that Gift Vouchers and Purchase Vouchers are subject to different conditions. They may also be restricted to specific product categories, as indicated on the website.

Conditions for Redeeming Gift Vouchers

Gift Vouchers ("Gift Vouchers") are prepaid vouchers issued by Leonardo Italian Fashion SRL, purchasable by customers and redeemable exclusively on the website. Gift Vouchers cannot be used to purchase additional Gift Vouchers.

Payment methods for purchasing Gift Vouchers include:

  • Bank transfer
  • Credit cards (Visa, MasterCard, American Express)
  • PayPal
  • Prepaid cards (e.g., "Postepay").

Gift Vouchers can only be used before placing an order, but they remain valid for future purchases. They are non-refundable for cash, and no interest is accrued on the balance.

In a single order, credits from multiple Gift Vouchers can be combined, as well as combined with Purchase Voucher credits. If a Gift Voucher balance is less than the order amount, the difference can be paid using other accepted payment methods.

Gift Vouchers can be canceled through Customer Service, provided they have not been used. A voucher is considered used if it has been redeemed during an order or credited to a customer’s account on the website.

Conditions for Redeeming Purchase Vouchers

Purchase Vouchers are valid for three months and can only be used once during an order process. They must be applied before confirming the order. Purchase Vouchers are not cumulative, non-transferable, and do not accrue interest. Any unused balance on a Purchase Voucher will not be refunded. If the order amount exceeds the voucher value, the difference can be paid with other accepted methods.

If products purchased with a Purchase Voucher are returned, the voucher value will not be refunded.

7. Right of Withdrawal

As stipulated by the Consumer Code (Legislative Decree No. 206 of September 6, 2005), the following terms and conditions govern the right of withdrawal in favor of the Consumer.

Exercise of the Right of Withdrawal by the Consumer
In compliance with the provisions of the Consumer Code, the Consumer may withdraw from the Contract without any penalty and without providing a reason by sending written notice within 14 (fourteen) working days. The communication must be sent via registered mail with acknowledgment of receipt (though the acknowledgment is not essential to prove the exercise of the right of withdrawal), or via fax or email, provided that the communication is confirmed via registered mail with acknowledgment of receipt within 48 (forty-eight) hours to the following address:

The 14-day period for sending the communication begins on the day the Consumer receives the Product. Upon receipt of the above-mentioned communication by Leonardo Italian Fashion SRL, the parties are released from their contractual obligations, except for those already performed in whole or in part.

If the Product has been delivered by Leonardo Italian Fashion SRL, the Consumer is required to return it within 10 working days from the date of receipt. The Product is considered returned once it is handed over to the Post Office or the courier.

To exercise the right of withdrawal, the Product must remain substantially intact and meet the following conditions:

  • Be properly packaged in its original packaging, in perfect resale condition (not damaged, altered, or soiled) and include tags, all accessories, usage instructions, and documentation.
  • Be accompanied by the delivery note (included in the original packaging) to enable Leonardo Italian Fashion SRL to identify the Consumer (Order number, name, surname, and address).
  • Show no signs of use beyond those compatible with normal testing of the item. It must not exhibit prolonged usage (beyond a few minutes) that exceeds the time necessary for a test and must remain in a condition that allows for resale.

It is sufficient that the item is returned in a normal state of preservation and has been used with standard care. Leonardo Italian Fashion SRL will evaluate compliance with the above conditions. If the Product does not meet these requirements, the withdrawal will not be effective.

The only expenses borne by the Consumer for exercising the right of withdrawal are the direct costs of returning the Product. If the Consumer has exercised the right of withdrawal in accordance with the provisions outlined, any payments already received by Leonardo Italian Fashion SRL will be refunded. The refund will be processed within 30 (thirty) days from the date of receipt of the withdrawal notice or, if earlier, from the date the returned Product is received.

The risks of destruction or damage to the Product during return shipping lie with the Customer. In such cases, the Product will not be considered intact, and the withdrawal will not be effective.

8. Warranty and Complaint Management

Purchases made by Consumers are subject to statutory warranty regulations, including those provided by the Consumer Code (Legislative Decree No. 206 of September 6, 2005), where applicable. If defects or faults are found in purchased Products, the Consumer must notify Leonardo Italian Fashion SRL within two months of discovering the defect, as stipulated by these General Terms and Conditions. The Consumer may request repair or replacement of the Product, at their discretion, unless the chosen remedy is objectively impossible or excessively burdensome compared to the alternative.

Leonardo Italian Fashion SRL will proceed to repair or replace the requested Product within a reasonable time from the Consumer's request. Consumers are encouraged to describe the defect or fault in detail and, if possible, provide order documents or relevant information such as Order number, name, and address.

If no response is received within 10 (ten) working days, the Consumer should send a follow-up request. Consumers should also ensure emails are not blocked by spam filters or encounter technical delivery issues.

If repair or replacement is impossible, excessively burdensome, delayed beyond a reasonable period, or causes significant inconvenience to the Consumer, they may request a price reduction or termination of the Contract. Termination is not permitted for minor defects where repair or replacement is impractical or excessively costly.

The above provisions do not apply to defects in Products purchased by Professionals, for which Leonardo Italian Fashion SRL provides no guarantees except where mandated by law.

9. Changes to the General Terms and Conditions of Sale

When these General Terms and Conditions are updated, Leonardo Italian Fashion SRL will promptly publish the modified version on the Website and notify users. The updated version will apply to new Orders from the date of publication. For Orders already placed, the previous version of the Terms and Conditions will remain in effect.

10. Replacement Clause

Should any provision of these Terms and Conditions or the Contract be deemed invalid or unenforceable, in whole or in part, the remaining provisions will remain valid and effective. Leonardo Italian Fashion SRL and the Customer agree to negotiate in good faith to replace invalid provisions with clauses that achieve the same results while preserving the economic purpose of the agreement.

11. Jurisdiction for Dispute Resolution

For disputes arising from Contracts governed by these Terms and Conditions, jurisdiction lies with the Civil Court where the Consumer resides or is domiciled within Italy. In all other cases, the applicable codified legal framework will determine jurisdiction.

Marketing Consent and Notifications

By accepting marketing terms during checkout or subscribing via our tools, you agree to receive notifications (order updates, including abandoned cart reminders), marketing offers via SMS, and transactional messages such as review requests. Message frequency varies, and consent is not a purchase condition.

We may change the phone numbers or short codes used to manage the service, with prior notification. We disclaim liability for failed, delayed, or incorrect delivery of information via the service, as well as any reliance on such information.
